Custody and Parenting Your rights and responsibilities as a parent are established by California's laws. California's law also establishes the parent's rights from birth to adopt, to be legally married to their children, and their responsibilities for the care and welfare of their children. There are rules that outline the steps a parent must follow when the California courts find that the parent is unfit to parent his or her children. These forms allow you to identify the type of case your child is in before you go to court. These forms can aid you in your decision whether to proceed with a custody or a termination hearing. Child Custody Issues/Placement To apply for a Divorce, Parentage, or other custody order, or to ask for an order to change a custody arrangement, you must complete the Court-Approved Custody and Paternity Order form. To learn more about how to proceed with a dispute about a custody and/or visitation order, you can download the form from the Family Law section. You have the right to be heard by the court. The court must consider the information you enter for your case, the information the person or the legal guardian of the property with care of the child has provided, and any other factors that are available to the court. If you are unhappy with what you receive from either the court or any guardian of your child(men), you may file a written request for review of the order or an informal appeal.
